In 2019, the First Criminal Enforcement Judge Rafael Alcón granted house arrest for serial rapist Richard Choque Flores because he allegedly had an “incurable disease.” The judicial officer explained to Page Seven Digital that the offender should return to prison in the middle of last year.

“Richard Choque has benefited from home detention because he had chronic gastritis and asthma. In addition, he argued that he was taking care of his mother, ”says Judge Rafael Alcón’s resolution.

Consulted by this means, the judge assured that he does not clearly remember the medical reasons that made him grant the 18 months of house arrest, but he affirmed that Choque should return to prison in the middle of last year.

“He argued illnesses, I don’t remember well, that’s why he is given 18-month house arrest (…), he had to return by mid-2021, if not he has returned, they have an obligation to enforce it,” the lawyer told this medium.

Judge Rafael Alcón is the brother of former Judicial Councilor Gonzalo Alcón, and the judicial resolution granting house arrest bears his signature, reported Correo del Sur.

Due to this apparent irregularity, the Judicial Council announced this Thursday that the court that in 2019 issued house arrest for Choque will intervene.

“It was Dr. Rafael Alcón Aliaga (who initiated Choque’s house arrest), he is a transitory judge, and well, coincidentally he is the brother of counselor Gonzalo Alcón Aliaga. Why first this sentence would not have been executed, for what reasons is it determined to give the benefit of home detention to a syndicate of this nature, we hope that from the intervention that is made in the next few hours both to the court and to the room criminal, the information can be clarified much more, “said the president of the Council of the Judiciary, Marvin Molina.

The head of the Magistracy anticipated that for this case a high-level commission made up of the national director of Control and Supervision and the national head of Transparency of the Council of the Magistracy was appointed and sent to La Paz, to proceed with the intervention of the criminal execution court in the city of El Alto.

Judge Alcón affirmed that he is preparing his defenses to deliver them to the Judicial Council and that he is still a judge of another court, so he does not have authorization to answer queries from the media.
