Council of Ministers approves bill that raises taxes on games and sports betting online

This initiative will be sent to the Congress of the Republic for discussion and analysis in the respective commissions.

The bill proposes a direct tax applied to the Net Income (Net Win). Likewise, the distribution percentages are established, as well as the beneficiaries on the basis of administrative competence and their relationship with the activity subject to regulation.

In this sense, it is established that of the 100% collected from the Games Tax, 40% will go to the Public Treasury, the remaining 20% ​​goes to the Peruvian Sports Institute (IPD) and 40% to the Mincetur according to the following internal distribution: 25% to the work of control and supervision of the activity and 75% to the promotion and development of tourism.

According to the Minister of Foreign Trade and Tourism, Roberto Sánchez, an important step has been taken to regulate this activity that has been generating an important economic movement (approximately S/ 4,500 million annually) without yielding income to the national treasury.

In addition, the minister pointed out that it is urgent that these operations be controlled in an integral way, paying taxes and complying with adequate conditions, as has happened in Colombia, Mexico, Argentina, and much of the United States and Europe.

The Council of Ministers was in favor of the Mincetur proposal because it establishes a legal framework that will make it possible to safeguard transparency in gambling and the integrity of sport, the promotion of responsible gambling, the establishment of access controls to protect vulnerable sectors and prevent money laundering, assets and financing of terrorism, among others“, said.

He added that the proceeds (around S/ 160 million per year) may be invested in the reactivation of tourism, in addition to public infrastructure works and promoting sports. “The government of President Pedro Castillo is clear that this activity must be regulated efficiently for the benefit of all Peruvians.”, he added.

The draft bill emphasizes that the Mincetur will be the entity responsible for authorizing the use of technological platforms and physical premises for games and sports betting, so it is crucial that these companies are registered in the Single Taxpayer Registry.

In addition, they must have a legal representative in Peru and a domain with the ending “.pe”.

It also refers that the control of the technological platforms will be carried out by physical and/or logical, face-to-face or remote access. The proposal also prohibits the participation in remote sports games and betting of minors and people with gambling addiction.

At the same time, companies that do not have the respective sectoral authorization will be prohibited from signing advertising or sponsorship contracts. Regarding administrative sanctions, these include: reprimand, fine (from 1 to 500 UIT), suspension of activities, cancellation of authorization and/or administrative registration, disqualification for up to 10 years and permanent disqualification.

It is important to mention that the proposal indicates that after being enacted, the Mincetur must issue the regulation within a period not exceeding 60 business days.

It should be noted that, from the date of entry into force of the rule, companies must comply with what is stated in the legal device within a period of one hundred and 120 calendar days.
