Cruzeiro and Gremio were denounced this Monday (23), by the Sports Justice Prosecutor’s Office, by discriminatory chants sung by fans on the 8th, in the victory of the Minas Gerais team by 1 to 0, for the sixth round of the Série B of the Brazilian Championship, held at Estádio Independência, in Belo Horizonte. The Fox was also denounced for not preventing and repressing the throwing of objects on the field. The person most likely to be harmed by the complaint is Cruzeiro. Among the penalties provided for in the Brazilian Code of Sports Justice (CBJD) – paragraph 1 of article 243-G – the winning team may lose the three points provided for in the competition regulations if the infraction committed “simultaneously by a considerable number of people linked to the same sporting entity” is proven.

In a statement, the Prosecutor’s Office stated that it received news of infraction (NI) denouncing homophobic chants sung both by Cruzeiro fans (Arerê, Gaúcho gives oc* and speaks tchê), and by tricolores (Maria plays volleyball).

Article 243-G of the CBJD deals with the practice of a discriminatory, contemptuous or outrageous act, related to prejudice based on ethnic origin, race, sex, color, age, elderly person or person with a disability. The penalty varies from suspension of five to ten matches – if practiced by an athlete, even if an alternate, coach, doctor or member of the technical commission – to suspension for a period of 120 to 360 days, by any other person. In addition, the club may receive a fine of R$100 to R$100,000. The offending fans who are identified “will be prohibited from entering the respective sports venue for a minimum period of seven hundred and twenty days”, in accordance with the provisions of paragraph 2 of article 243-G.

In the summary of the Cruzeiro x Grêmio match, referee Flávio Rodrigues de Souza reported the throwing of objects on the lawn.

“I must inform you that in the 27th minute of the first half, after the Cruzeiro SAF team had scored, two glasses of beers were thrown into the field of play, one in the midfield near where the reserve bench of the Cruzeiro team was. Grêmio RS and another behind the visiting team’s goal next to the photographers. I also inform you that both came from where the Cruzeiro SAF fans were”, described the judge.

Article 213 of the CBJD provides for a fine of BRL 100 to BRL 100 thousand when “failure to take measures capable of preventing and repressing the throwing of objects on the field or place of the sporting event”.
