Only 9.73% of public employees are in the career system

Of almost 600 thousand public employees, only 61 thousand 524 are active public servants in the administrative career

Fourteen years after the enactment of Law 41-08 on Public Function, which regulates and defines the entry of servants into the administrative career in the State, only 9.73% of the country’s public employees are incorporated into said system.

According to data from the Ministry of Economy, until January 2022 in the Dominican Republic there were 599 thousand public employees. From those, according to statistics from the Ministry of Public Administration (MAP)only 61,524 public servants are active in the administrative career.

Among the 61,524 career employees, 44 thousand 305 are from teaching (72.01%) and 15 thousand 367 from general administration (24.98%). Likewise, 1,111 of the career of the Public Ministry (1.81%); 646 from the tax office (1.05%) and 95 from the diplomatic office (0.15%).

According to MAP data, apart from the active career employees there are currently 4,035 under review to enter the administrative career, while 13,647 are inactive.

For what purpose are they admitted to the administrative career?

Article 4 of the Civil Service Law, enacted on January 16, 2008 by then President Leonel Fernández, established that the general administrative career had the purpose or purpose of guaranteeing the professionalism, stability and development of public servants. It also defined the existence of special administrative careers, as a professional civil service system designed from the general administrative career system and the specific characteristics of certain public spheres.

With the legislation, employees were given rights such as permanence and growth as a public servant. However, the momentous step of entering this system has not been for most employees.

Law 41-08 establishes that in addition to the general rights of public servants, there are special rights of career officials, the holding of a permanent position in the public administration classified as career and stability in the administrative career. Also reinstate in his position when his dismissal is contrary to the causes expressly stated in this law and receive the wages not received between the date of dismissal and the date of reinstatement, without prejudice to the compensation that the contentious-administrative jurisdiction may consider. It is the decision of the employee to accept the restitution in the same destination and in case of not accepting it, the institution must relocate him in another destination.

Other benefits of being in the administrative career

It is also a benefit of the career employee to be promoted within the administrative career, to exercise the other rights that are specifically established by law or regulation in his favor due to his status as a career servant. In addition, promote him based on his merits to positions of a higher level and remuneration, in accordance with the needs and possibilities of the public administration.

Career public officials who are appointed to high-level or trusted positions must return to their original position when removed. Likewise, the time spent in high-level or trust positions will be computed for the purpose of seniority in the administrative career.

Principles and requirements to enter the race

On July 21, 2009, Leonel Fernández issued decree 524-09 of regulations for the recruitment and selection of personnel in the public administration for the application of Law 41-08. The decree establish six principles. These are: principles of Merit, Transparency, Publicity, Impartiality, Legality and Economy.

The requirements for admission to the career are: meet the parameters of the position to be held; be under fifty-five (55) years of age and not be a creditor of a retirement or pension benefit. In the same way, demonstrate through free competition that they have the suitability required by the position or class of positions; pass the compulsory induction cycle, in charge of the National Institute of Public Administration (INAP) and pass the trial period of up to twelve (12) months, in accordance with the position manuals.
