Administrator is disqualified for more than 2 years from the public function in the Municipality of Yauli

Luis Richard Rojas Rodríguez, administrator by profession, is disqualified for two years and six months from exercising a mandate, position, employment or commission, which is of a public nature. This was ordered by the head of the 3rd Preparatory Investigation Court of Analí Giovana Soto Donaire, after approving the partial agreement of the early termination to which the accused accepted.

Rojas was being investigated by prosecutor Mariela Diony Vilca Aza, provincial deputy prosecutor of the Specialized Prosecutor for Corruption Crimes of Huancavelica Officials, for having colluded with two other people to approve a company that did not meet the requirements.

The prosecutor raises the investigation against the administrator based on the events that occurred in 2015, when the accused was a member of the permanent selection committee of the Yauli District Municipality (MDY) for the contracting process for the execution of the work ” Improvement and Expansion of the offer of educational services of the IE N° 36470 of the community of Chacapampa, district of Yauli – Huancavelica”.

With Mayoral Resolution No. 154-2015-AL-MDY/A, on May 19, 2015, the then mayor, Simión Taipe Sedano, formed the committee with officials Reimundo Zacarías Damián Laura, Gamaniel Soto Rojas and Luis Richard Rojas Rodríguez, who was assuming the role of Deputy Logistics Manager of the MDY on the aforementioned date.

What the prosecutor was investigating was that, despite not having the requirements to carry out the work, the members of the committee approved and approved the Yauli Consortium, which was represented by Catherine Betzabe Baldeón Toro.

Among the requirements that were not met was the minimum 5 years of experience and that the construction resident must have a minimum of four years of experience. Likewise, the aforementioned, who are now accused, acted in such a way that the selection process gave the appearance that there were more than two bidders; however, one of the presumed bidding companies informed the MDY that it did not participate and that, even, the authenticity of the documents with which they used the name of the company for this process is questionable.

Finally, the consortium used the curriculum vitae of a master builder without his consent, let alone his signature.

Given all of the above, the prosecutor had the necessary elements for the accusation of the crime against the public administration, in the form of simple collusion.

Being so, in hearing, the technical defense and the accused decide to take advantage of an early termination, a legal figure with which the investigated accepts the imputed crimes in order to reduce their sentence or have a less severe sentence.

After evaluating the agreements and the procedural parties, the magistrate decided to approve the early termination and sentenced Rojas to two years and six months of effective sentence converted to 129 days of community service, which will be established by the Office of Control of Media Libre of the INPE of the city of Huancavelica.

The sentenced person was also disqualified from public office for the same time of the Failure to comply with the provisions of the judge, the sentenced person runs the risk that the effective sentence will be executed for his internment in the prison.
