What happened to the constitutional reform project

The project of Constitutional reform that drives the Executive power is stuck on stage Economic and social Council (ESC) because the main opposition parties maintain their refusal to provide any type of support for its approval.

The party representatives ratified this Thursday that they will not change their position regarding the official proposal, while the legal consultant to Executive powerAntoliano Peralta, admits that everything remains the same and they are giving priority to other initiatives.

He announced that when the discussions with all the projects on the table are finished, they will try again with the Constitutional reform.

“The project of Constitutional reform it is as it was, the only thing that was modified was the calendar to learn about it at the CES, priority was given to other bills pending discussion”, he pointed out.

José Dantes, Secretary of Legal Affairs of the Dominican Liberation Party (PLD)emphasized that they will not change their position regarding the proposal to amend the Magna Carta.

“The proposal is inopportune, due to the economic and social crisis that the country is experiencing, and its content seeks the opposite of what it says it wants to obtain,” he stressed.

In keeping with the People’s ForceHenry Merán, member of the political leadership and representative of the organization before the CES, was emphatic in reiterating that he will not participate in any discussion regarding a Constitutional reform.

He maintained that until now he is not aware that the issue has been discussed outside the CES.

“The FP has constantly reiterated that it will not participate in any discussion that deals with this issue. The other opposition parties are also in that situation”, he pointed out.

Hector Guzman, Vice President of the Dominican Revolutionary Party (PRD)), also reconfirmed the opposition position that this organization has to a reform of the Constitution.

He specified that the representative of the PRD participated in the last meeting of the thematic table on Transparency and Institutionality, under the condition that the constitutional issue be left off the agenda.

“There is no variation,” Guzman said.

The consultations were open on February 2 of this year 2022 and according to the CES calendar, the closing is scheduled for April 2.

The next meeting of the Transparency and Institutionality table will be held on Wednesday, March 30.

Currently the space discusses 12 bills submitted by the Executive power. These are the drafts: of the Contentious Administrative Jurisdiction; Buying and Hiring; Good Governance and Conflict of Interest in the Public Sector; of Public Services; of Public Function; Participation in Public Management; on State Advertising; of Free Access to Information, and the Office of the Comptroller General of the Republic.

Also the projects of regulations of: application of the Organic Law of Public Administration, of the Law on Salary Regulation and of Sanitary Career.

The proposal to reform the Constitution of the Republic, restates the composition of the National Council of the Judiciary, proposes the unification of the elections, the elimination of electoral drag and the manner and time in which the members of the High Courts will be elected.

It also proposes that the Attorney General of the Republic be renamed Attorney General of the Republic, which will not be part of the CNM.

The initiative seeks that the judges of the Constitutional Court, the Supreme Court of Justice, the Superior Electoral Court be elected by the CNM for a single period of nine years, among others.
