Tocumen Airport initiates procedure for removal of abandoned aircraft

The Tocumen International Airport, SA approved through resolution of the Board of Directors No. 030-JD-22 of March 10, 2022, the procedure for the declaration of abandonment of aircraft with national or foreign registration in disuse that are deteriorated and abandoned in the cargo terminal grounds.

In accordance with the resolution approved by the Board of Directors of Tocumen SA, the procedure for declaring an abandoned aircraft may be initiated ex officio, by complaint or at the request of an interested party, addressed in writing to the general management of Tocumen SA, accompanied by the documentation evidence that allows assessing the state of abandonment in which the aircraft is, as well as the risks for the operability, security of the airport and the environment.

All requests from the interested party for declaration of aircraft abandonment must be accompanied by a technical report issued by the Civil Aviation Authority, detailing the condition or risk it represents for operability, air safety, operational safety, which must contain the location of the aircraft, its generals, description of possible cargo and any additional information that is deemed pertinent and convenient.

According to the Tocumen SA resolution, it may remove or relocate those aircraft that represent a danger or affect the operation of the airports managed by the Tocumen airport, either in a place inside or outside the area terminal area. In the event that the aircraft is subject to a precautionary measure, such as kidnapping, seizure or seizure by any other authority, Tocumen SA may request the responsible authority to move the aircraft to its facilities, based on operational safety reasons. , area security and for operational reasons.

In cases where the aircraft has been abandoned for more than 1 year at an airport managed by Tocumen SA, at the date of publication of this resolution in the Official Gazette, the owner or operator will have a period of 30 calendar days, From the last publication referred to in the thirteenth article of this resolution, to remove the aircraft otherwise, it will be understood that he has no interest in recovering it and has abandoned it.

Thirteenth Article: “The administration of Tocumen SA, will publish a notice for three consecutive days in two newspapers of national circulation and after 30 calendar days, counted from the last publication, and if no natural or legal person has claimed, the declaration of abandonment will be made.

The Tocumen International Airport may dispose of these abandoned aircraft in the manner it deems convenient, useful or effective, with the prevalence of the best interests of the State. If the owner or operator of the aircraft appears and communicates its intention to respond and take responsibility for it, it must present a plan to vacate the area where the aircraft is located, within a period not exceeding 30 calendar days and cover any expenses additional product of the transfer, care, caused by the abandoned aircraft.

The owner or responsible person may file an appeal before the Board of Directors of Tocumen SA, within five business days after the last publication through a summons notice in two local newspapers with national circulation. The Board of Directors of Tocumen SA, will respond to the appeal resource within 30 calendar days, after submitting the respective document.
