They present an appeal to the TCP that asks to declare the pension law that transfers contributions to the Manager unconstitutional

Senator Rodrigo Paz Pereira from Tarija and representatives of retirees and contributors to the AFPs arrived this Monday at the Plurinational Constitutional Court (TCP) to file an Abstract Unconstitutionality Action (AIA) against two articles of the pension law.

“They intend to take the 23,500 million dollars (of the pension resources), of which 7,200 are not known where they are, they want to seize and confiscate that money without having consulted the owners”, claimed Paz after presenting the appeal in the TCP.

He denounced that the questioned law “confiscates” the contributions of Bolivian pensions through articles 176, numeral I, and 149, subparagraph b, against the Constitution that protects the property right of the contributors.

The parliamentarian clarified that they are not against the Public Managerbut they demand respect for the right of Bolivians to choose another option that is not a public institution that manages their resources.

The lawyer for the retirees, Gustavo Blacutt, explained that they are asking the TCP to declare the unconstitutionality of the articles 176, numeral I, and 149, subparagraph b, which confiscates the right, not only of retirees, but of all contributors, to decide who is going to manage their money, their individual contributions.

He indicated that the contributors signed an agreement, an adhesion contract with the AFPs and to transfer these funds these people should have been consulted.

“The transfer of those funds without prior consultation it goes against the right to free decision, which is a fundamental element of the right to property of all Bolivians, and is established in article 56 numeral I of the CPE,” said Blacutt.
