Santo Domingo – With the slogans “Dominican law caused death”, “by a criminal code that respects women” and “the causal they save lives” several organizations and social groups stood this Wednesday in front of the National Congress, to commemorate today the tenth anniversary of the death of the young Rosaura Almonte Hernández.

The coalition for life and women’s rights pronounced after 11:00 in the morning, warning of the danger that the prohibition of abortion represents for women and girls in all their circumstances, even to save their lives.

Four deputies and the families of three other women who, like “Esperancita” also died due to lack of access to an interruption of pregnancy, were present at the act.

The protesters reiterated the call to President Luis Abinader, to fulfill their word of supporting a draft Criminal Code that does guarantee the rights and to let the case of Rosaura Almonte Hernández impunity before the Dominican justice.

It is recalled that Rosaura Almonte Hernández, known as “Esperancita”, died at the age of 16, after being diagnosed with leukemia and being denied chemotherapy because she was pregnant.

By exhausting a turn and receiving a letter from Rosanna Almonte, mother of Esperancita, the deputies Juan Dionisio Rodríguez Restituyo, José Rodríguez, Pedro Martínez and Carlos Sánchez (the latter member of Parlacen) reiterated their support for the three causes and the continue to defend women’s rights.

In the letter, the coalition of women warn about the cost of maintaining abortion and citigating the cases of Rosaura Almonte Hernández (“Especita”, 2012), Damaris Mejia (2012), Carmen Diones Martínez Bonilla (2018) and Winifer Nuñez Blessed Blessed (2021).

Both Almonte and relatives of other similar cases have joined the movement of women who for more than 20 years have fought for the approval of abortion on three grounds: in cases of rape or incest; in cases of fetal unfeasibility; and when the pregnancy puts the health or life of women and girls at risk.

“After my daughter’s death, other young women have died in similar circumstances. It is outrageous that history repeats itself. It is cruel that more families lose their daughters, sisters and nieces to a law that instead of saving them, condemns them. But I’m not giving up. In memory of my daughter, I will continue to raise my voice until the three grounds are approved in Congress,” said Esperancita’s mother.

The National Congress is scheduled to approve in this legislature the bill of the Criminal Code, which does not contemplate the three causes.

In addition to joining the voices that currently call for a modern Penal Code that protects the rights of women, Rosa Hernández continues to seek that the Dominican justice system clarify the events surrounding the death of her daughter, punish those responsible and adopt structural changes. necessary to prevent situations like your daughter’s from happening again in the country.

In 2013, Rosa Hernández, represented by Women’s Link Worldwide, initiated two judicial processes in the Dominican Republic. A criminal complaint, which is still in the initial stage and in which they still do not have full access to the file. And another process that seeks to determine the patrimonial responsibility of the State, at the head of the Ministry of Health, for the death of Rosaura.

The latter was restarted in July 2022 before the Superior Administrative Court, which ordered the reopening of the evidentiary and merits stage, after a decision by the Supreme Court of Justice that declared admissible an appeal filed by the representatives of Mrs. Hernández after obtain an unfavorable decision, and that was not duly motivated, of the appeal filed in 2013.
