Subcommittee of the Peruvian Congress details constitutional complaint against Pedro Castillo and three former ministers

The Subcommittee on Constitutional Accusations of the Congress of Peru reported, this morning, the entry of Constitutional Complaint No. 328, presented by the National Prosecutor’s Office, against Pedro Castillo Terrones as the alleged co-perpetrator of the crime against the powers of the State and order constitutional law, in the form of rebellion, provided for and sanctioned in article 346 of the Penal Code, to the detriment of the State and, alternatively, for the crime against the powers of the State and the constitutional order -conspiracy-, criminal offense provided for and sanctioned in the Article 349 of the Penal Code against the State.

In addition, for being the alleged perpetrator of a crime against the public administration-abuse of authority, criminal offense provided for in sanctioned in article 376 [primer párrafo] of the Criminal Code, to the detriment of the State; and, as the alleged perpetrator of the crime against public peace — crime against public peace, in the form of crime of serious disturbance of public peace, criminal offense provided for and punished in article 315-A [primer y segundo párrafo] of the Criminal Code, to the detriment of society.

The complaint includes the former president of the Council of Ministers, Betssy Chávez Chino, as the alleged co-perpetrator of the crime against the powers of the State and the constitutional order, in the form of rebellion, provided for and sanctioned in article 346 of the Penal Code, to the detriment of the Condition; and, alternatively, of the crime against the powers of the State and the constitutional order – conspiracy, criminal offense provided for and punished in article 349 of the Penal Code, to the detriment of the State.

Also included in the complaint for the same assumptions are the former Minister of the Interior, Willy Huerta Olivas, and the former Minister of Foreign Trade and Tourism, Roberto Sánchez Palomino.

OTHER COMPLAINTS

In the session led by the president of the subcommittee, Lady Camones Soriano (APP), 7 other constitutional complaints were also reported, including constitutional complaint 212 formulated by five citizens against José Pedro Castillo Terrones for the alleged constitutional violation of articles 38, 39, 43, 44, 45, 48, 49, 62 and numerals 1), 2), 4), 15) and 24) of article 18 of the Constitution.

Also the constitutional denunciation 237 formulated by the citizen Juan Ubaldo Valdivia Gonzáles against José Pedro Castillo Terrones; for the alleged constitutional violation of article 175.

Likewise, it was informed of the constitutional complaint 326 formulated by the congresswoman Rosselli Amuruz Dulanto against José Pedro Castillo Terrones; the former president of the Council of Ministers, Aníbal Torres Vásquez; the former Minister of Foreign Affairs, César Landa Arroyo and the former Minister of Defense, Daniel Barragán Coloma and the former Minister of Economy and Finance, Kurt Burneo Farfán, among other members of the previous cabinet.

Before he realized the constitutional complaint 200 formulated by the citizen Guillermo Olivera Diaz; against 79 congressmen from various benches for the alleged violation of articles 206, 43, 102, 38, 39, 44, 45, 46, 103 and 106 of the Constitution; and the alleged commission of the crimes of abuse of authority and criminal gang, in a real contest of criminal offenses with summation of penalties provided for in numeral 50, punishable acts provided for in articles 376 and 317-B, respectively, of the Penal Code.
