Monzón case: the motivation of a law to deny custody to femicides

In the Penal Code, the legislator proposes to reform article 338 Bis so that it is punished with three to eight years in prison, a fine of 500 to 1,500 days of minimum wage, in addition to dismissal from office and disqualification from three to 10 years, to the official who fraudulently encourages, promotes, tolerates impunity, omits, delays or hinders an investigation in the case of femicide.

In current legislation, the penalty for whoever is responsible for femicide is up to 60 years in prison, and 70 against whoever has killed a pregnant woman.

The fight that generated a law

Silva Ruiz’s initiative has already entered the Justice Prosecution and Administration Commission, but it has yet to be ruled on. It is expected that it will be after September 15, when the third period of sessions begins, when it is discussed and, where appropriate, approved.
