The Justice of Rio de Janeiro denied, this Tuesday (1st), a request for the release of anesthesiologist Giovanni Quintella Bezerra, accused of rape a woman during her delivery. The decision is by Judge Carlos Marcio da Costa Cortazio Correa, from the 2nd Criminal Court of São João de Meriti, in Baixada Fluminense.
The doctor was accused of raping a woman during childbirth in the surgical center of the Hospital da Mulher Heloneida Studart, in São João de Meriti. The record of the crime was made by the cell phone of one of the professionals who accompanied the surgery. The device was hidden inside a cabinet located inside the operating room. Quintella was arrested in flagrante delicto on July 10 and his arrest was converted into preventive detention after undergoing a custody hearing.
Defense
Among the requests presented by the anesthesiologist’s defense, there was also the recognition of the illegality of the evidence obtained by environmental capture and, consequently, the absence of just cause due to the lack of evidence of materiality and criminal authorship. Both were rejected.
In the decision, the magistrate also scheduled the first hearing of the case for December 12 this year. The process is being processed in judicial secrecy.
