Judge revokes decision that removed president of Itapemirim from office

Judge João de Oliveira Filha, from the 1st Court of Bankruptcy and Judicial Reorganizations of the Court of Justice of São Paulo (TJ-SP), revoked the decision that removed Sidnei Piva Rodrigues from leading the Itapemirim group, which is undergoing judicial recovery. The magistrate points out that there was an extrapolation of the competence of the first instance and that the removal of the businessman from the presidency went against the grain of how the higher court is positioned in these cases.

The initial decision met a criminal representation of Camilo Cola Filho, heir to the company. He alleged that Piva committed illicit conduct that harmed consumers, suppliers, employees and creditors, through the operation of Itapemirim Transportes Aéreos (ITA).

On December 17, 2021, the company suspended all ITA operations, leaving passengers stranded across the country. At the time, the group reported that the stoppage was temporary, motivated by an internal restructuring.

After the problems in air transport, Itapemirim also announced, at the end of December, that it would withdraw bus lines and reduce the number of cities served on its road routes. The conglomerate has been in judicial recovery since 2016.

In January, the National Civil Aviation Agency (Anac) prohibited Itapemirim from resuming the sale of airline tickets.

THE Brazil Agency requested a position from Itapemirim, but there was no response until the publication.
