The 3rd Control Court of Aragua, in charge of Anabell Suárez Osal, granted a substitute precautionary measure to the deprivation of liberty for Enny Alexandra Portillo Morfe, Physiotherapy studentwho was exposed in a video at the time of applying therapies to a three-month-old baby at the CDI Aguacatal located in Maracay, Aragua.
As a result of the dissemination of this material on networks by a self-styled Venezuelan influencer, the Public Ministry charged him in October 2022 intentional homicide to a degree of frustration, illegal practice of medicine and usurpation of functions, according to file 3C-26.647-22 to which we had partial access.
The preliminary hearing was held last Thursday at the Maracay Palace of Justice where Inés Morgado, the baby’s mother, spoke, who assured that her son is fine, that he did not suffer any harm from Enny Alexandra’s therapies and blamed the College of Physiotherapists to viralize the video, a situation that also caused damage to both her and her family nucleus.
Carlos Carpio, the student’s lawyer, also spoke at the hearing and said that “the victim has been atrophied by public ridicule and my client has been held for a long time.”
At that hearing, the prosecutor Vanesa Vitale took the floor, who ratified the accusation against the student and requested to open a trial. The prosecutor who originally opened the procedure, Víctor Acacio Girón, did not attend the hearing because he was removed from that case after receiving a warning, revealed a judicial source.
The student Enny Portillo stated that she was following instructions from her professors attached to the University of Health Sciences. She added that she likes her career and she is happy serving the community in the area of health.
The Court dismissed Portillo for the crime of frustrated homicide and she admitted the facts regarding the remaining two crimes: illegal practice of medicine and usurpation, an approach that was supported by the baby’s mother.
By virtue of this, the judge ordered the conditional suspension of the process, granted her a precautionary measure that replaces imprisonment, and imposed three months of community work on Portillo precisely at the CDI Aguacatal where she was completing internships.
Once Judge Anabell Suárez issued her decision, the Public Ministry, represented by prosecutor Vanesa Vitale, expressed its rejection of it and requested that it be suspended until a higher court determined whether or not the student should open a trial. In this regard, the Court agreed to refer the file to the Court of Appeals of Aragua for a decision.
