The Temuco Court of Appeals accepted an amparo appeal in favor of Emilio Berkhoff, the former leader of the Arauco Malleco Coordinator (CAM) convicted of an arson attack and robbery in the Lumaco commune in 2020.
In this way, the decision of the Traiguén Guarantee Court was revoked, which on May 3 had decided to refer Berkhoff to the Bio Bio prison, but now -after the determination- he will do so in the Lebu Preventive Detention Center, in the Araucanía region.
Lawyer Humberto Serri, head of the Mapuche Local Public Criminal Defense Office, gave the details of the decision of the Temuco Court of Appeals.
“The court confirms an illegality in the actions of the Traiguén Guarantee Court, which in the first instance had agreed to the transfer and later, when this resolution was already final, decided to make a completely contradictory decision affecting the rights of my client” , he pointed.
“This ruling is important to us, not only for Emilio and his family, but also for all the people who are deprived of their liberty. It highlights that the deprivation of liberty does not entail the limitation of other rights, quite the contrary,” sentenced.
