The head of the Political Judgment Commission of the Chamber of Deputies, Ana Carolina Gaillard, assured that the process requested by President Alberto Fernández to the members of the Supreme Court of Justice will be carried out “with great seriousness and transparency.”

The national deputy for the Frente de Todos (FdT) also considered that in the dissemination of the chats attributed to the Minister of Security and Justice of the City of Buenos Aires, Marcelo D’Alessandro, -who requested a license to prepare his defense in the case – it shows “the collusion between judges and sectors of politics”.

“Promoting the impeachment was a decision of our President, taking into account the facts of public knowledge. It was the straw that broke the camel’s back to show what we all suspected: the collusion between judges and sectors of politics. Clearly there is no power independent judiciary,” said Gaillard in statements made this morning to Radio La Red.

In addition, the legislator added that “there is no precedent for a political trial of all the members of the Court” and assured that the process will be carried out “in the best way with great seriousness and transparency in the face of society.”

On Tuesday, Alberto Fernández and 12 governors sent a note addressed to the deputy to order “the necessary measures to carry out the impeachment process” against the members of the Supreme Court.

In the document that they will send to the Chamber of Deputies, the president and the governors requested that the pertinent provisions be made to promote the opening of the process against the ministers Horacio Rosatti, Ricardo Lorenzetti, Carlos Rosenkrantz and Juan Carlos Maqueda.

The chat scandal

The request for impeachment was requested after the dissemination of chats that D’Alessandro would have maintained with Silvio Robles, spokesman for Rosatti, president of the Supreme Court and the Council of the Magistracy, was made public.

“Rosatti’s most trusted person spoke with the Buenos Aires minister and recommended the best strategy to have a favorable ruling regarding the co-participation funding that the City should receive”Gaillard argued.

The deputy explained that there is still no scheduled meeting date for the Commission and that it remains to wait “for the project to enter and the Decree (of the Executive Power) to convene the extraordinary sessions because Congress is in recess.”

“I would believe that this week the Decree will be signed to convene Extraordinary. Once that happens, we will be able to convene the Commission,” he explained.

Likewise, the deputy explained that the Commission will deal with the project and “rules by a simple majority if the investigation is opened.”

“To vote on the opinion and start the session, a quorum is not necessary in the Commission. Of the 31 members, 16 are needed, only a simple majority and with the votes of the Frente de Todos is enough to move forward,” he said.

In this case, the evidentiary stage begins where “documentary evidence, testimonials, visual inspections” and other evidence are presented.

“The defendant is summoned with all the evidence to inform him of his right to defense. There the accusatory opinion of the origin or not of the accusation is made and it is signed with a simple majority,” he added.

Finally, the project goes to the Chamber of Deputies, where “two thirds of those present are required to advance the accusation”, which, if approved, is sent to the Senate, “where the defendant is judged.”

“We want a transparent, democratic and independent Judiciary, which is what democracy and the Republic need. The main thing is that the Judiciary overwhelmed the powers of other powers and that will be discussed within the framework of the Commission,” the statement concluded. legislator.
