Wilfredo Pedraza, lawyer of Ollanta Humalahe considered that the sentence on his defendant has occurred arbitrarily and that he was not in his calculations.
“Mr. Humala is impressed by such a decision. In our calculations and projections, we had ruled out an immediate execution, mainly because it is domain of the legal community that sentences must only reasonably be fulfilled after being confirmed in the second instance, because this is provided by the TC. Therefore, it was not a possibility, a distant possibility, but obviously what happened today seems like an outrage,” said Pedraza.
“The rule in a democratic country is that such high convictions must be fulfilled only when confirmed in the second instance. There is a judgment of the Constitutional Court that is binding, which says exactly that, by principle of double instance, by presumption of innocence, by the right to freedom, the penalties must always be executed after second instance,” he added.
Pedraza considered as an “excess” the provision of the Judiciary and said they will appeal the judicial provision, trusting a new resolution in favor of its defendant.
“He has, in this case, more than 10 years of investigating; he and his lady have presented themselves when they were given preventive detention, he has been present in all hearings … He has 10 years of impeccable procedural behavior and, in that logic, an excess of this nature seems to me,” he said.
“We, obviously, will wait for the hearing that comes to know, in its integrity, the conviction, we will file the corresponding appeal, because this is just the first half, this is a two -stroke and more party and more […] We do not assume, as the Prosecutor’s Office does, a final sentence, in a criminal process is won or lost, and what sends is the evidence. Regarding Nadine Heredia, who was also sentenced to 15 years in prison and is in the Brazilian embassy waiting for him to be granted political asylum, the lawyer said he had no information about her.

As is known, the Judiciary declared Ollanta Humala and Nadine Heredia as co -authors of the crime of money laundering and imposes a 15 -year prison for both and the civil reparation payment of 10 million soles.
