Civic Forum rejects the appointment of the TSJ magistrates for their lack of independence

UCV Humanities graduates are left without representatives “for now” after the TSJ ruling

The elections in the Faculty of Humanities and Education of the UCV to choose the representation of graduates in the co-government were very close and it was the last one in which the results were given, after a recount of the votes was made, which showed that the representatives of the ruling party lost in the 11 faculties

The Electoral Chamber of the Supreme Court of Justice (TSJ) suspended the effects of the voting and scrutiny act and, consequently, of the acts of adjudication and proclamation of the winners in the elections of graduates of the Faculty of Humanities and Education of the University Central of Venezuela (UCV).

The president of the Electoral Chamber, magistrate Caryslia Rodríguez, indicated in sentence 079 decided to admit a contentious appeal filed by Wilmer Vásquez Matheus, who challenged the resultsbecause the request for review of votes in that Faculty appears sealed by the electoral subcommission of the UCV.

For the magistrate, “without this ruling meaning a pronouncement on the merits of the case”, the request for review should have been sealed by the Electoral Commission, “the body empowered to do so.”

Rodríguez also argued in his brief that “it can be presume, at this initial stage of the judicial process, the risk of violating the constitutional right to vote provided for in article 63 of the Constitution. For this reason, it considers “necessary the provisional and immediate restitution of the infringed legal situation”, that is, the effects of the review are suspended, until final judgment is handed down.

The elections in the Faculty of Humanities and Education of the UCV to choose the representation of graduates in the co-government were very close and it was the last one in which the results were given, after it was made a recount of the votes, in a process that was carried out throughout the university on July 13 and that culminated in victory in most of the faculties for factors opposed to the national Executive.

There it was determined that the plate “Humanitas Graduates” was the winner of the elections. The aforementioned organization -of opposition tendency- obtained 536 votes in favor while “Together for heritage”, related to Chavismo, reached 531 votes. That means that the supporters of the ruling party did not win any power of the 11 available in the graduate election that took place in recent days.

They call to defend votes in the UCV

The Humanitas Graduates panel reacted to ruling 079 of the Electoral Chamber and accused the TSJ of “altering the official results issued by the Electoral Commission of the UCV and endorsed by all the panels during the count, thus seeking to disregard the will and rights of the ucevistas”.

In a statement, the group asserted that the vote count at the School of Education followed the regular procedures, under the supervision of the Electoral Commission, “and with the permanent presence of witnesses from all the lists. The final and official act of the voting result was endorsed and signed by representatives of all the options”.

They also assured that the recount decision was agreed upon by all the parties, including the one linked to Chavismo, on the very morning of the election.

For this reason, they called on graduates, professors, students and authorities “to defend our university against this obscene attack on the ucevistas, our institutions and the right to elect our representatives.”
