Mercado’s defense will present its appeal against the decision at the latest on Monday. Lawyer Luis Mayhua, who also represents Vladimir Cerrón in some processes, said that he considers preventive detention an “unfair, abstract subjective” decision. Mayhua also criticized the Public Ministry and said that he did not know what he was accusing his sponsor of. For this reason, Mercado kept silent, because he did not know what the imputation was.

Prosecutor Aladino Lazo, filed a 9-month preventive detention order against him, after the syndication of the former regional infrastructure manager, Gerardo Manuel Portocarrero Almonacid.
In his speech, the prosecutor pointed out that Mercado was the one behind this event and that the money came from the construction project of the university campus of the Juan Santos Atahualpa Intercultural University of the Central Jungle.
The prosecutor also pointed out that Mercado should be imprisoned because if not, when he returns to office he could manipulate other managers he trusts.
The defense made it clear that the accusation against Mercado is vague and the typification of the crime of generic active bribery, in this case, would not be correct, it also dismissed the manager’s version for falling into contradictions and in none of the audios that works in hands of the prosecution links it directly to the facts under investigation.
For his part, Mercado broke his silence and said “Those who denounce me say that I was the one who sent Portocarrero to buy votes and trance, that is false, Mr. Judge, because nowhere in the audio where I am heard is there any mention of buying votes, it is not said: Mr. Villazana, support me with your vote (…).
