According to the lawsuit filed in court, Star Seguros had agreed in December 2021 to pay the company Disposable Services as compensation for a fire that affected 75% of its manufacturing plant, which has not been canceled to date.
The Third Court of First Instance in Civil, Commercial, Transit and Banking of the Judicial District of the Metropolitan Area of Caracas decreed an executive embargo measure on the assets of Estar Seguros for $2.25 million for non-payment of a claim to a client.
The judicial measure occurred after the breach of the payment agreement established between the insurer and Servicios en Desechables, the company that took out policies for several years to insure its industrial plant located in the state of Miranda.
In its sentence, the court also ordered to notify the Superintendence of Insurance Activity (Sudeaseg) in case the embargo fell on movable property owned by Estar Seguros.
Servicios en Desechable is a 100% Venezuelan capital company founded 40 years ago and is dedicated to the manufacture of diapers, sanitary napkins, daily protectors and bed centers, among others. In December 2019, the plant suffered an accidental fire that affected 75% of its production capacity.
During the investigation of the incident that lasted more than a year, To be sure did not respond to the payment of the policy, so the board of directors of the affected company decided to claim compensation in court, which represents a significant investment in time, resources and legal decisions that not every person or company can dispose of.
“We went to court to claim payment of compensation and after 12 months of litigation in court, both parties compromised and decided to reach a payment agreement for approximately one third of the value of the damaged goods, an agreement that was approved by the competent court”, explained the Board of Directors of Disposable Services in a press release.
He specified that Estar Seguros undertook to pay compensation in three parts in 2022, but in March of this year the insurer again requested a new payment agreement for alleged lack of money and then went to court resorting to subterfuge to not honor the commitment made and whose term has expired.
After the judicial embargo decree, the insurer has presented several legal appeals that the judicial authorities themselves have declared inadmissible.
“It is worrying that insurance companies such as Estar Seguros do not honor their legal obligations to pay their policyholders, even though the reinsurance companies of Estar Seguros have allegedly fulfilled their part, not even when the judicial authorities order it, alleging that they do not have the resources. to comply with its own insurance activity”, the company stated.

Situations like this, the company indicated in its press release, raise concern in the country about the commitment of insurers to the people and companies that hire them to attend to any unforeseen event that affects their health or property. Many others affected, most of the time, they cannot afford legal proceedings to claim compliance with their policies being helpless due to the lack of attention of these companies.
“We are still waiting for the agreed payment to be fulfilled before the judicial authorities”, while explaining that due to the non-compliance by the insurer they have not been able to re-establish their main production lines.
However, the company assured that they make “a great effort together with our more than 100 collaborators to meet the demand for essential health items, such as: diapers for children and adults, hospital bed centers, among others, which are currently so much needed in our country.
