As the days go by after the publication of the private investigation into the attack on former baseball player David Ortiz, more questions arise, and one of those questions is what would happen if the Public Ministry determines that the alleged drug trafficker César Emilio Peralta, alias El abuser, he did order the ex-baseball star to be killed.
The situation is complicated. Not only because Peralta will be judged outside the Dominican Republic for drug matters, but in the country there is already a group of defendants for the shooting of David Ortiz, in which case they do not mention “El abuser” at all.
According to explanations from jurists, once the Public Ministry has in its hands the report of the former Boston Police Commissioner, Ed Davis, hired by Ortiz to analyze the event, and establishes that Peralta should be charged for the shooting of the former baseball player, then, the process would be long, because the first thing is that a connection must be established between the alleged drug trafficker and the 13 men who are charged in this case.

Another thing is that, if the prosecutors want to bring Peralta to justice in the Dominican Republic, he would have to be tried once his trial in Puerto Rico concludes, where he faces three charges issued since 2018 by a federal grand jury on the island, which accused of trafficking heroin and cocaine with shipments from Colombia, the Dominican Republic and Venezuela to Puerto Rico and other United States jurisdictions.
In the hypothetical case that in the end “The abuser” is subdued on Dominican soil for the attack on David Ortiz, and that a court finds him guilty, according to lawyers, he could face a sentence of up to 20 years in prison.
While here in the country, Sixto David Fernández, whom the Dominican authorities say was really aimed at the shot that wounded David Ortiz, decided to dismiss the complaint with the constitution of a civil action that he filed against the 13 defendants in this case, according to what he explained. via telephone to elCaribe, his lawyer José Rafael Ariza.
The reason for leaving the case as a civil actor, said Ariza, is that Fernández “was not convinced by the investigation that (the shot) was against him.” “My client never believed that (the attack) was against him, he told me from the first day and until the last day, we gave up the civil action, he never believed that version,” said the lawyer, who also explained that Fernández was sued in the case on his recommendation.

Lawyer Ariza said that he cannot comment on Ortiz’s private investigation since “I have not seen it.” “What I can tell you is that if an intellectual author appears now, that investigation has to prove that there is a link between the material authors who are subjected and that intellectual author… That would not delay the process at all because that would be an addition, to add a person to the file for their participation,” he said.
