Due to the health emergency decreed by the coronavirus pandemic unleashed in December 2019 that arrived in our country during 2020, the National Social Security Administration (ANSeS) had suspended the pensions of Cristina Fernandez de Kirchner due to the fact that the social security entity, with a resolution, stopped paying retroactive salaries of article 1 of Law No. 24,018, among them, those of the vice president.
As the health emergency culminates on December 31, starting next year (tomorrow), the retroactive should be paid to the vice president Cristina Fernandez de Kirchner. This amount is close to 176 million pesos. From the PRO (Republican Proposal) they expressed that the payment of the amount would be illegal.
It is in this framework that Graciela Ocaña, a national deputy of the PRO, denounced before the Justice that the vice president and ex-president does not correspond to collect the retroactive, since this action would harm the ANSeS. Ocaña described the retroactive payment of pensions as “embezzlement” and addressed the head of ANSeS, Fernanda Raverta, alleging that this official would harm the state coffers for the benefit of her political boss.
Besides, Ocaña suggested that Raverta’s actions could also incur crimes 248 and 260 of the Criminal Code, these being: abuse of authority and violation of the duties of public officials and, on the other hand, embezzlement of public funds.

For his part, Néstor Carlos Kirchner, was President of the Nation from May 25, 2003 to December 10, 2007. Previously, he became mayor of Río Gallegos between December 10, 1987 and December 10, 1991, governor of the province of Santa Cruz between December 10, 1991 and May 24, 2003, and deputy for the province of Buenos Aires from 2009 to the October 27, 2010, when he passed away.
