The Court of Santiago de Cuba denies the ‘habeas corpus’ to José Daniel Ferrer

The Provincial Court of Santiago de Cuba rejected this Tuesday the habeas corpus presented in favor of José Daniel Ferrer, leader of the Patriotic Union of Cuba (Unpacu), according to communicated yesterday Wednesday his sister, Ana Belkis Ferrer Garcia. In its resolution, the chamber also certifies that the opponent is in the Mar Verde prison serving a sentence.

“On the afternoon of this Tuesday, July 5, 2022, the Court of Santiago de Cuba refused to account for José Daniel Ferrer García, who had been missing for 31 days. We continue to demand proof of life,” claimed the activist’s sister, that he considers the document useless as long as he is not allowed to speak with it.

The order indicates that the opponent has been in Mar Verde since August 12, since the sanction of house arrest was revoked after trying to participate in the anti-government demonstrations of 11J. The Court affirms that Ferrer has been granted all the benefits contemplated by the penitentiary system, which include family visits, telephone communication and enjoyment of the conjugal pavilion “without any violation of his rights”.

For this reason, it considers that there is no room for habeas corpus presented by his wife, Nelva Ismarays Ortega Tamayo.

Last June 18, Ana Belkis Ferrer denounced on social networks that she had not been able to speak to her brother for two weeks. “Two weeks without taking it out for the measly five minute phone call,” she said.

Ortega Tamayo was in Mar Verde on June 24 asking to see her husband and the authorities showed her a video that, they argued, had been recorded that same day, a fact that deeply upset the family.

Ana Belkis Ferrer, who has reported that her brother is still in danger in prison, where, she says, he is subjected to “physical and psychological torture”, has made responsible to Raúl Castro, Miguel Díaz Canel and the Communist Party of Cuba of what may happen to “his valuable and precious life”.
