Durov informed that he will appoint a legal representative for Brazil and asked the STF to reconsider the suspension decision.

“I apologize to the Brazilian Supreme Court for our negligence. We definitely could have done a better job,” he said.

Through a message published on the platform, Dorov said that problems with corporate email addresses prevented the platform from being communicated about the STF decisions that determined the blocking of investigated profiles.

“It appears that we had a problem between our corporate emails and the Brazilian Supreme Court. As a result of this miscommunication, the Court banned Telegram for not responding,” he declared.

The director also informed that the platform complied in February with a determination to suspend profiles and that the Supreme used an old email address to contact the company.

Block

Earlier, Moraes complied with the request of the Federal Police (PF) and ordered the blockade, which took place within the scope of an investigation that is underway in the Court involving journalist Allan dos Santos.

In February, Moraes had ordered the messaging app to block profiles accused of disseminating disinformation, however, the STF was unable to summon the representation in Brazil of the company responsible for the app.

On another front, at the beginning of the month, the Superior Electoral Court (TSE) also tries to locate the company’s representatives, through the law firm in Brazil. A letter was addressed to Pavel Durov.

According to the PF, the app is “notoriously known for its stance of not cooperating with judicial and police authorities in several countries”.

Moraes stressed that Telegram has been failing to comply with the decisions that determine the suspension of profiles, in an attitude of “total omission to stop the dissemination of fraudulent news and the practice of criminal offenses”.

“The disregard for Justice and the total lack of cooperation between the Telegram platform and the judicial bodies is a fact that disrespects the sovereignty of several countries, not being a circumstance that occurs exclusively in Brazil and has allowed this platform to be repeatedly used for the practice of numerous criminal offenses,” he said.

Minister of Justice

At the beginning of the evening, the Minister of Justice and Public Security, Anderson Torres, declared that he has determined that sectors of the portfolio should study a solution to restore to the people “the right to use the social network they wish”. Torres referred to the dispatch of Alexandre de Moraes.

In a post made on social media, the minister also said that Brazilians are being harmed by the decision.

“Millions of Brazilians being suddenly harmed by a monocratic decision. I have already determined to several sectors of @JusticaGovBR to immediately study a solution to restore the people’s right to use the social network they want”, he declared.
