STF denies transference of Roberto Jefferson to private hospital

Federal Supreme Court (STF) minister Alexandre de Moraes denied the request of former federal deputy Roberto Jefferson to be transferred from the Gericinó Penitentiary Complex, in Rio de Janeiro, to the Samaritano Barra Hospital.STF denies transference of Roberto Jefferson to private hospital

By note, the STF informed that the medical report sent by the State Penitentiary Administration Secretariat (Seap-RJ) indicates a medical situation of “absolute normality”. Also according to the document, Jefferson only needs additional exams.

“At this moment, the prison hospital is fully capable of providing adequate treatment to the prisoner, with no evidence that his health condition requires a new exit from the prison establishment,” said the minister in his decision.

Alexandre de Moraes, however, authorized the visit of private doctors, provided they strictly observe the rules for admission to the prison establishment.

The lawyer Luiz Gustavo Pereira da Cunha filed a petition with the STF requesting the transfer of the former parliamentarian on Sunday (24) to the private hospital.

“Roberto Jefferson’s state of health is delicate, serious. He, in fact, is at real risk of death and has relapsed pyelonephritis. He has already entered the prison system with this disease, which is a bilateral bacterial infection of the kidneys. There, he got worse, he was hospitalized for over a month. He was discharged from hospital, but not discharged from the hospital”, added the lawyer.

As the lawyer, on Friday (22) night, Roberto Jefferson was referred to the Emergency Care Unit (UPA) that works within the Penal Complex of Gericinó when he felt chills, had fever and low blood pressure. After treatment, he returned to his cell, but on Saturday (23) in the afternoon, he was taken to the hospital, which also works in the penitentiary complex, where he remains hospitalized for monitoring of a “sudden illness”.

Due to the health situation, Jefferson, who is the PTB’s National President, asked for an indefinite leave of absence from his position at the head of the party. In a statement, the PTB informs that Roberto Jefferson “will remain hospitalized until Tuesday (27), when he will undergo a new ultrasound exam.”

Prison

Roberto Jefferson was arrested on August 13 at his residence, in the municipality of Comendador Levy Gasparian (RJ), after Alexandre de Moraes’ decision, on the accusation that he was using videos on his social networks to attack the powers of the Republic and the state democratic law. After going through all the formalities to enter the prison system in Rio, Jefferson was taken to the Bangu 8 prison, in the Gericinó Penitentiary Complex.

On September 4, the minister authorized the transfer of the former deputy from the prison to Hospital Samaritano, in Barra da Tijuca. He maintained pre-trial detention and ordered Jefferson to remain only in the hospital and be monitored by electronic ankle bracelets. On October 14, the former parliamentarian was discharged and left the hospital, escorted by the PF and taken back to Gericinó, where he remains imprisoned.

Defense

Lawyer Luiz Gustavo Pereira da Cunha, who defends Jefferson, said he fears for the life of the former deputy, if there is no transfer to a private hospital.

“The defense receives the decision of Minister Alexandre de Moraes with indignation. This indicates the degree of enmity he has with my client, further setting the suspicion. If Minister Alexandre de Moraes wants a corpse, he will have a corpse,” said the lawyer.
