The reforms determine that the Federation will have the National Guard as a permanent, professional, public security force made up of personnel of military origin with police training, dependent on the secretariat of the National Defense branch.
This institution will be in charge of executing the National Public Security Strategy, formulated by the secretariat of the Public Security branch.
The text of the constitutional amendment provides that the investigation of crimes corresponds to the Public Ministry, the police and the National Guard, which will make up the National Public Security System and must coordinate among themselves to meet the objectives in the matter.
In addition, Congress will have the power to issue laws that regulate and establish requirements and limits for the participation of the Army, Navy and Air Force in matters of internal security and in tasks supporting public security.
The Senate of the Republic, meanwhile, will be empowered to ratify the appointment of the senior leaders of the National Guard proposed by the President of the Republic.
The constitutional changes recognize the rights, benefits and social security of those who provide their services in the National Guard, on equal terms with those who are part of the Armed Forces.
Once it is published in the Official Gazette of the Federation and the reform comes into force, the Federal Executive will be able to use the National Guard for the internal security and external defense of the Federation, as well as in tasks supporting public security. , in the terms established by law.
For the declaration, the Senate received the approval votes of the congresses of Baja California, Baja California Sur, Campeche, Chiapas, Chihuahua, Colima, Durango, Guerrero, Hidalgo, State of Mexico, Michoacán, Morelos, Nayarit, Oaxaca, Puebla, Quintana Roo, San Luis Potosí, Sinaloa, Sonora, Tabasco, Tamaulipas, Tlaxcala, Veracruz, Yucatán, Zacatecas and Mexico City.
