SCJN will discuss and vote on the Cuevas-Morán project on March 28

“Four months will have passed since I proposed to the plenary session the attraction of the matter (…) it is clear to us that, far from an intention to prolong any situation, in the particular issue, it is precisely about resolving this matter,” he announced at a press conference .

The day before, the head of the Court announced that Gutiérrez Ortiz Mena would be in charge of preparing the new project on this case and carrying it out “as soon as possible”, given the seriousness of the matter. These are the amparos under review 540/2021 and 541/202.

Last Monday in public session, by ten votes against and one in favor, the Court rejected the project of Minister Alberto Pérez Dayán and returned to Minister Gutiérrez to prepare a new one.

The bill proposed to grant protection to Gertz’s sister-in-law, Cuevas Morán, and her daughter Alejandra Cuevas against the arrest warrant and the formal prison order issued for the death of her brother Federico. However, they did not get to the bottom of the matter.

Zaldívar Lelo de Larrea considered that a new project should be awaited, which focuses on the substance of the issue, so that it can be discussed whether said freedom is granted.

“It is wrongly insisted that in November of last year, when the referee was going to resolve this matter, the freedom of Mrs. Alejandra Cuevas was going to be voted for. This is absolutely false,” she noted.

The minister said that the project that was going to be submitted to the Court for a vote at that time, was an amparo project for effects, “a similar project similar to the one that was rejected last Monday.”
