Real Estate Builder Smart Terra, to return money

The Financial Superintendence ordered the company Constructora Inmobiliaria Smart Terra SAS to immediately suspend the operations that constitute the unauthorized capture or collection of money from the public.

The measure adopted by Resolution No. 0886 of July 12, 2022 It also orders the immediate return of the resources received through unauthorized operations and disqualifies said company to carry out activities that constitute the collection or collection of money from the public in a massive and habitual way, using any modality, either directly or through other natural or legal persons.

The Financial Superintendent established that the company Real Estate Builder Smart Terra SAS acquired obligations with 432 people to whom it received a total of $7,928 million, committing to repay the amount received from each one plus a fixed monthly return that ranged between a rate of 3% and 5%.

The Financial Superintendent explains that said obligation was assumed by the company through contracts called “antichresis constitution”, “capital investment” and “mutual”without anticipating in exchange the real and effective delivery of goods or the provision of services.

The Financial Superintendence sent a copy of the measure, among other authorities, to the Superintendence of Companies for the corresponding intervention and to the Attorney General’s Office for the purpose of conducting criminal investigations.
