New work. The President Pedro Castillothe head of the Council of Ministers, Hannibal Torresas well as the members of the ministerial cabinet, will face a constitutional complaint filed before the Subcommittee on Constitutional Accusations (SAC) of Congress for having raised the question of trust with the aim of repealing the law that limits the referendum.
Indeed, the Integridad Civil Association issued this complaint before the head of the SAC, Lady Camones (Alliance for Progress)this Wednesday, November 23, against Pedro Castillo and all the ministers of State for allegedly violating articles 90, 106, 108 (numerals 1 and 10) and 133 of the Political Constitution of Peru.
According to said organization, Hannibal Torres acted “unconstitutionally” when appearing before the Chamber of Parliament, last November 17, raising the question of confidence. Said measure was signed by the president and the entire Council of Ministers in order to repeal law 31399the same one that regulates articles 40 and 44 of Law 263000 that promotes citizen participation (referendum).
They also argue that the approval and repeal of said law “is the exclusive and exclusive competence” of Congress. They then mention that Pedro Castillo and his ministers would havethe sole purpose of forcing a denial of confidence and promoting the dissolution of Congressillegitimately using article 134 of the Constitution”.
In this sense, it is argued that the reason for issuing the constitutional complaint against Castillo Terrones and the entire cabinet is “for having made a question of confidence illegal and unconstitutional, for the sole purpose of dissolving the Congress unlawfully.”
“We will demonstrate that the question of confidence presented is inadmissible because it is contrary to the sole article of Law 313555 and Article 86, subparagraph d) of the Regulations of Congress, and that the defendants have refused to acknowledge said inappropriateness, ignoring the express mandate of the law, for the sole purpose of forcing the illegitimate closure of Congress”, reads the document.
Complaint indicates that Aníbal Torres did have intentions “to close Congress”
On the other hand, it is called “false and tendentious” statements by Aníbal Torres:
“What’s the point of making a question of confidence if the intention is not dissolve congress after a double rejection? Obviously none. Pedro Castillo and his Council of Ministers have made an abusive exercise of the right to impose a question of confidence in order to promote the closure of Congress”.

TC ordered Congress to annul final report of treason complaint against Castillo
On November 22, the plenary session of the Constitutional Court declared founded the habeas corpus presented by the defense of Pedro Castillo regarding the report approved by the SAC, which recommended his disqualification for treason.
The TC resolved to annul the qualification report and the final report approved by the SAC for “violating the right to due motivation in parliamentary headquarters”.
The document contains the signatures of the six magistrates signing the resolution declaring “the nullity of the agreement of the Subcommittee on Constitutional Accusations of Congress (…) as well as the final report of Constitutional Complaint 219.”
