The Criminal and Correctional Judge 21, Marcos Fernández, processed this Tuesday with preventive detention the six detainees for a group rape perpetrated days ago in the Buenos Aires neighborhood of Palermo and placed an embargo on their assets for 35 million pesos, sources reported. judicial.
The prosecutions fell on the defendants Ángel Pascual Ramos (23), Lautaro Dante Ciongo Pasotti (24), Thomas Fabián Domínguez (21), Steven Alexis Cuzzoni (20), Franco Jesús Lykan (24), Ignacio Retondo (22) and Thomas Fabián Dominguez (21).
At six, the judge prosecuted them for “sexual abuse with carnal access, aggravated by the intervention of two or more people” (a crime with a sentence of between 8 and 20 years in prison), but Retondo and Domínguez also add a indictment for the “minor injuries” caused to a witness.
In addition, the magistrate ordered embargoes for 35 million pesos for each of the accused.
According to the sources, during the trial, the judge held that everyone acted with “a previous plan, with an agreement of wills and roles.”
The fact
The incident occurred on the holiday of last Monday, February 28 in the afternoon, in broad daylight, on Calle Serrano at 1300, in Palermo Soho, where a couple of bakers and another neighbor intervened when they saw that inside a Volkswagen Gol parked next to the sidewalk they abused a girl in a group.
While four of the defendants -Ramos, Ciongo Pasotti, Cuzzoni and Lykan- were inside the car with the victim, the other two -Domínguez and Retondo- sang and played the guitar on the sidewalk, in a maneuver that is believed to have been distraction and to act as a “bell”.
The 20-year-old raped woman recognized from photos those who, from what she later found out, sexually abused her.
In her statement, the victim said that she met five of the six detainees (she saw the rest on the street, later) that same day at the “Ro Tecno Bar”, located at 1600 Thames Street, where she arrived after 5 in the morning with a friend, and that hours later he went out with the group to a plaza on Calle Soler, where they bought and drank beers and that after drinking from those cans, he does not remember anything until he wakes up in the hospital.
Several videos from security cameras of the Police and shops captured the group arriving at noon with the girl already staggering and in an obvious state of intoxication, to continue drinking in Plaza Serrano and in a nearby kiosk, where a first abuse is seen , after which she was taken to the car where the gang rape took place.
Toxicology studies revealed the presence of marijuana, methamphetamine and amphetamine in the victim’s system.
She had only admitted to having consumed alcohol -she had a dosage of 1.3-, and marijuana, but not synthetic drugs, so it is being investigated whether the defendants gave her a drink mixed with “ecstasy” pills, in the “after” where they met to the victim.
Meanwhile, amphetamines were not detected in the six defendants, but cocaine (in four of them), marijuana (in five) and psychoactive drugs (in one).
