Judge Adriano Loureiro Binato de Castro, from the 4th. Criminal Court of Duque de Caxias, in Baixada Fluminense, decreed today (19), the preventive detention of Ecuadorian doctor Bolívar Guerrero Silva, 63, and nursing technician Kellen Cristina de Queiroz dos Santos for the attempted murder of patient Daiana Chaves Cavalcanti, 35 years old.
On May 3 of this year, Daiana had cosmetic surgery on her buttocks, back and abdomen at Hospital Santa Branca, in Caxias, on her buttocks, back and abdomen and had complications that led her to return to the hospital the following week, reporting abdominal pain and inflammation of the suture points, which expelled secretions.
In the decision, the judge recalled that, with the worsening of her health, Diana was hospitalized again on July 1, presenting weakness and anemia, with hypothyroidism and systemic arterial hypertension. “Without proper care and without performing tests that would attest to the risk of a new surgery, and also without observing Diana’s clinical condition, the patient underwent another abdominoplasty surgery to correct the damage caused by the first surgery, with the purpose of breast reduction and repositioning”, added Castro.
“By performing the new surgery, the accused [Bolivar Guerrero] knew the possibility of causing the patient’s death and consented to the production of this result, as he was completely indifferent to her health conditions”, said prosecutor Cláudia Portocarrero, from the 3rd Prosecutor’s Office for Territorial Investigation of the Nucleus of Duque de Caxias, when filing the complaint.
According to the complaint, Guerrero found that he would not be able to reverse the worsening clinical condition and, in order to hide the consequences of his conduct, he refused to transfer the patient to another hospital. “Kellen Cristina de Queiroz dos Santos convinced Daiana to perform the surgery even though she was weakened, in addition to being present during the surgical act, without any technical training to do so.”

Daiana Cavalcanti was transferred, by court decision, on July 21, to the Federal Hospital of Bonsucesso, where she remains hospitalized and has already undergone four surgical procedures for breast reconstruction and removal of necrotic tissue below the six and belly. .
