President Jair Bolsonaro announced this Friday (25) the submission to Congress of a series of bills in the area of public security. Among the proposals is the so-called illegality exclusion, which eases penalties for public security agents who commit excesses in confrontations.
“We must work and seek understanding between the powers so that in the future, I hope it doesn’t take too long, [para que] the policeman, when fulfilling his mission, goes home to rest, to be reunited with his family; and the next day to receive a medal, not a visit from a justice official”, said the president at the ceremony of awarding the medal of the Order of Merit of the Ministry of Justice.
According to the Ministry of Justice, the measure is to expand the possibility of self-defense for public security professionals. “The objective is to improve criminal legislation to provide greater legal support to members of public security agencies”.
Another proposal amends the Criminal Organizations Act to punish more rigorously crimes committed by gangs that surround cities to promote “Novo Cangaço” actions. The bill determines a penalty of imprisonment from 6 to 20 years.
In another measure, it is proposed to modify the Anti-Terrorism Law to include “the premeditated use of violent actions that generate risk to the population, with ideological and political ends, that attack public or private property”, as an act of terrorism. Individual or collective conduct, of a peaceful nature, by people in political demonstrations, social and religious movements, among others, are excluded.
A change was also proposed in the Penal Execution Law to increase the percentage of sentence that must be served before a criminal can be eligible for regime progression. In addition, there is a project that amends the Penal Code in relation to recidivism, which would increase from 5 to 7 years.
The package of legislative projects also includes a device to guarantee the payment of compensation to victims who have suffered criminal acts and to make reimbursement to the Unified Health System (SUS) mandatory. For the purpose of this proposal, wages and amounts applied could be pledged, in addition to the use of 30% of the balance of the employee’s Severance Indemnity Fund (FGTS) account for the payment of compensation to the victim.
