Magdalena Gómez: Wixárikas and the presidential commitment to justice

AND

n the resistance history of the indigenous peoples in the face of the dispossession of their territories, we find moments of triumph against the State, whose future destinies do not always have consolidated outcomes of achieving justice. However, they value the steps forward that they manage to take, for the simple reason that, in general, they happen as a result of their struggle, in which they usually pay high costs. His time horizon does not run in parallel with the temporal logic of the six-year terms, which does not imply that some are unaware that they have meant a watershed. This is the case of the Yaquis regarding President Lázaro Cárdenas and his historic decree of restitution, which even today is the legal and political foundation and the parameter of their claims. General Cárdenas did not fail them, it was his successors who have incurred in complicity and dispossession to evade profound justice, whose reversal today is proposed by the so-called 4T justice plan whose elaboration procedure and results would be in the process of being shown strong evidence.

As we know, the modality of official intervention towards indigenous peoples called justice plans is in progress. There will be an opportunity to analyze its context and content, also in its mechanisms of representation… For now, it is interesting to highlight a process that would be twinned with justice but by decision of its actors and with good reasons and grievances, they rejected the intervention of Sedatu and INPI and did not accept its inclusion in the model of the so-called plans.

This is the one that has been generated autonomously, as a result of the Wixárika Dignity and Consciousness Caravan, which began on April 25, led by authorities and community members, on a journey on foot of more than 900 kilometers, with extremely high temperatures. for 32 days, from the communities of San Sebastián Teponahuaxtlan and Tuxpan, in Jalisco, in order to reach Mexico City and talk, at the National Palace, with the President of the Republic, to explain to him that, despite having Judicial resolutions that recognize their rights against the dispossession motivated by the arbitrary and illegal occupation of a group of mestizo ranchers have not been executed, so the restitution of more than 11,000 hectares of their territories is still pending. In the case of the Wixaritaris, their rituality accompanies them, especially in events that are significant to them. His lawyer Carlos González explained that the seven-hour stretch of the caravan’s walk, from La Marquesa to Mexico City, was done on an empty stomach and without drinking water; Later, they carried out a ceremony on the Tepeyac hill before arriving at the Zócalo, where they remained for three days before being received at the National Palace. The photograph he published on the front page is iconic the daywhere the ejido commissioner knocked on the Mariana Gate and shouted: Open up Andrew! (5/28/22). In an unprecedented political decision since Cardenismo, President López Obrador received the Wixaritari agrarian authorities: Commissariat of Communal Assets, the Treasurer, the Surveillance Council on Monday, May 30 and after listening to them and previously informed through the agrarian attorney, signed the commitment on justice to the joy of the Wixaritaris. They returned with it to their communities where they celebrated that the great effort was worth it.

I believe that it is not remote to imagine that the President of the Republic remembered with this Wixárika caravan, the great and also hard days of mobilization that he led from Tabasco to the capital of the country, such as the so-called Exodus for Democracy, of 50 days, to from November 25, 1991 that in its tour was adding participants, so that it had a massive entrance to the Zócalo of Mexico City, on January 11, 1992.

The commitment assumed and signed by the federal Executive is extremely complex, it demands full use. The ball has remained in the court of the federal government. The ranchers occupying foreign lands have already opened part of their strategy, which consists first of all in the absurdity of claiming their right with arguments and documentary citations that were eventually rejected in court. Nothing from them surprises, they say they are original heirs of the lands they illegally occupy, they express their contempt and racism against the Wixárika people, but they also slip the threat of using force, by pointing out that they will not allow them to enter their lands. However, they cannot hide that the presidential position hits them hard even when they consider that they have deceived him, that they have lied to him. Another front that they open is that of the governments of Jalisco, their enemy, and Nayarit, their friend. José M. Murià has already addressed part of the history behind what he called geographical dispossession ( the day, 4/6/22).

For the good of all, first the Wixaritaris.
