Martín Camacho, one of the lawyers for the governor of Santa Cruz, Luis Fernando Camacho, said this Friday that there is no obstacle for the authority to continue exercising its functionsdespite remaining in preventive detention in the Chonchocoro prison.

The jurist rejected the pressure exerted by the national government so that Mario Aguilera, lieutenant governor, exercises the powers of the incumbent. The Minister of Justice, Iván Lima, even threatened criminal action if powers are not transferred.

“In fact, the pressure has no logic or legal support, meanwhile, the governorin accordance with article 25 of the statute, do not resign, do not die or have any impediment, such as a conviction as res judicata, he is still governor, and we have seen different cases, ”said the representative of the governor.

Also, the lawyer criticized the delay in the judicial administration to set the date and time of the appeal hearingin which the governor is sought to recover his freedom, considering his arrest illegal and the procedural risks presented by the Prosecutor’s Office unjustified.

“The delay comes from the judicial authority, the judge should have sent the file on Saturday and on Tuesday we should have already had an indication, we are already a week away and it has not been indicated, this is retardation of justice, breach of duty and procedural delay”, he pointed out.

With reference to the accusations made by the Minister of Government, Eduardo Del Castillo, the lawyer called the accusations “daring” and criticized the way they try to justify the violent kidnapping that Camacho suffered. Likewise, he questioned that they involve private individuals with their financial accounts, violating their rights.

“I would ask the minister if he found out with the same speed where the millions of Bolivians from the Indigenous Fund went, which are the more than 900 private accounts where that money was distributed and if they have ordered a financial investigation; Nevertheless, order to investigate accounts that are not included in this investigationand that is a violation of privacy, due process and the right to legitimate defense,” he said.
