The Court of Appeals of Concepción decided to revoke the sanction against the national director of the Migration Service (Sermig), Luis Thayer, who last week had been suspended from his duties for 10 days by the same court.
According to information from La Tercera, this occurred after the Migration Service did not respond -within the established period and without giving an answer- a protection resource for the processing of a temporary visa corresponding to a citizen of Cuban nationality.
The situation occurred after learning that the Cuban citizen had withdrawn from the legal action -filed against the service- after her problem with her papers was resolved. Procedures that were delayed since the previous administration.
The entity communicated that “with the new account of the rapporteur and complementing the resolution of last July 20, in what is said in relation to the presentation of folio 24, bearing in mind only the withdrawal of the projection resource presented by the lawyer Pablo Daniel Peñaloza Parra, the suspension of functions of the Director of the National Migration Service, decreed in a resolution of July 11, is annulled.
Regarding the previous ruling of the Court, a 10-day suspension was requested against Thayer for not responding to a protection appeal for the processing of a temporary visa in favor of a Cuban woman.
However, from the Migration Service they indicated that “the processing of that visa was resolved and, by virtue of this, the user who presented the protection resource, upon seeing her request fulfilled, withdrew from the aforementioned resource, for which, In what is most relevant to our service, that is, the service to people, the request has been fulfilled”.
It should be remembered that the resolution against Thayer was pending the resolution of the Supreme Court, after an appeal presented by the lawyers of the Migration Service. However, the director of Sermig was not able to be suspended from his post.
