The Justice of Spain denied the Brazilian government request To extradite the Blogging Blogger Oswaldo Eustáquioinvestigated by the Federal Supreme Court (STF) for the accusation of involvement in undemocratic acts.
The blogger has an open arrest warrant in Brazil and fled to the European country amid investigations who investigated the suspicion that he acted to boost extremist attacks against the Supreme Court and Congress through social networks.
According to the decision of the Spanish justice, rendered yesterday (14), Oswaldo Eustáquio cannot be sent to Brazil because it is the target of an investigation with “political motivation”.
Suspension
After learning of the Spanish decision, Minister Alexandre de Moraes, rapporteur of the case at the Supreme Court, decided on Tuesday (15) to suspend an extradition process requested from Brazil by Spain. The case involves Vasil Georgiev Vasilev, a Bulgarian man who was arrested last month.
With the suspension, the accused will be released and must serve house arrest by monitoring by electronic anklet.
In the minister’s understanding, The extradition treaty between Brazil and Spain involves the requirement of reciprocity, that is, compliance with the agreement by the two countries.
Thus, Moraes understood that there was disrespect for reciprocity, determined the suspension of the Bulgarian extradition process and gave Spain’s ambassador to five days in Brazil to provide clarification.
Bulgarian is sought in Spain for drug trafficking. He is responsible for carrying a suitcase with 52 kilos of cocaine, which would be delivered to another investigated in Barcelona. The crime occurred in 2022.
