Judge refuses to lift suspension against works on section 5 of the Mayan Train

The First District Judge in the State of Yucatan, Adrian Fernando Novelo Perezratified the definitive suspension against the continuation of the construction works of section 5 of the Mayan Train, which goes from Playa del Carmen to Tulum, Quintana Roo.

In his resolution, the judge ordered to maintain “the definitive suspension of the claimed acts attributed to the National Fund for the Promotion of Tourism (Fonatur) and Fonatur Mayan Train”.

And although he modified the final suspension he granted in May, the judge did not publish the changes he made. Likewise, he set a hearing for next August 1, where, with a detailed report from the responsible authorities, he will be able to verify the status that awaits the definitive suspension granted on May 30.

The definitive suspension that remains in force was granted by Judge Novelo to a group of divers who filed a lawsuit alleging that the Mayan Train works, in section 5will cause irreversible damage to the complex system of caves, cenotes and underground rivers in the area.

The definitive suspension orders the federal government to “suspend or paralyze any act that has as its purpose the continuation of the construction of the fifth south section of the Mayan Train Project -with a line from Playa del Carmen to Tulum, Quintana Roo-, so that no allows the execution of works related to its construction, infrastructure, removal or destruction of the biodiversity of the land or any other activity that implies its material execution.

However, the president Andres Manuel Lopez Obrador reported on July 19 that he opted for Declare the works of the Mayan Train as national security, since “the time that (the construction work) had been stopped meant a high cost to the budget.” The federal president estimated that despite the delays the train will be in operation in 2023 as he promised.

This Monday, July 25, in his morning conference, President López Obrador affirmed that the protections promoted by environmental organizations are financed by the United States government, and for this reason he ordered the declaration of national security.

“A procedure established by law is used, which is to declare this work of national security for many reasons: because a foreign government is intervening, because money from the public treasury is being lost, money from the people, because it is a priority work” , he highlighted.
