Judge John Paredes Salas, of the Third Specialized Constitutional Court of Lima, admitted for processing the amparo lawsuit filed by Colonel Harvey Colchado against the president peter castle and other senior officials, seeking an end to the intimidation and obstruction of the work of the PNP special team coordinator.
However, despite the urgency of the case, the magistrate only scheduled the hearing for June 14, 2023, which means that his final resolution would be much later.
“This shows how collapsed the constitutional justice system is in Lima (…) of amparo it only has the name; in reality it is helplessness,” Luciano López, a lawyer for Colchado, told Perú21.
As he explained, this Monday a request for reconsideration will be presented to Judge Paredes so that the date is brought forward “due to the urgency that the case requires.”
“The obstruction, the hindrance and the annoyance to the work of Colonel Colchado are quite evident and that deserves urgency,” he added.
Although the substantive hearing would be in June 2023, the magistrate granted ten business days for the defendants to provide their defenses, through the PCM Attorney General’s Office and the Ministry of the Interior.
KEEP IN MIND:
- Lawyer Aníbal Quiroga remarked that the judge’s decision is “markedly unconstitutional and absurd.”
- “It violates what is called the reasonable term and what the Constitutional Procedure Code says, that the amparo has a preferential procedure,” he mentioned to this newspaper.
