The First District Judge in the State of Yucatan, Adrián Fernando Novelo Pérez, granted a second definitive suspension, now to the civil association Defending the Right to a Healthy Environment, AC, against the continuation of the works on section 5 of the Mayan Train.
“Antonella Vázquez Cavedon is granted, in her capacity as legal representative of Defending the Right to a Healthy Environment, Civil Association, the final suspension of the acts that the National Fund for the Promotion of Tourism (Fonatur) and Fonatur Tren Maya, a Variable Capital Stock Company, claim,” the judge determined.
However, the judge denied the precautionary measure to the association against the omission of the authorities to manage and request the various permits related to environmental regulations and the Regional Environmental Impact Statement (MIA-R).
“Antonella Vázquez Cavedon, in her capacity as legal representative of Defending the Right to a Healthy Environment, Civil Association, is denied the definitive suspension regarding the claimed acts that are attributed to the Secretariat of Agrarian, Territorial and Urban Development, Secretary of National Defense, Head of the Secretary of Environment and Natural Resources, General Directorate of Environmental Impact and Risk, Head of the Undersecretary of Management for Environmental Protection, both of the Secretary of Environment and Natural Resources, President of the States Unidos Mexicanos, Delegation of the Federal Attorney for Environmental Protection, based in Cancun, Quintana Roo, as well as the acts claimed from the National Fund for the Promotion of Tourism (Fonatur); Fonatur Tren Maya, Sociedad Anónima de Capital Variable, the latter consisting of the omission to manage and request the various permits related to environmental regulations and territorial planning in relation to Sections Five, Six and Seven of the Project called Tren Maya”, he mentioned. .
President Andres Manuel Lopez Obrador reported on July 19 that chose to declare the works of the Mayan Train as national securitysince “the time that (the construction work) had been stopped meant a high cost to the budget.”
The federal president estimated that despite the delays, the train will be operational in 2023 as promised.
This Monday, July 25, in his morning conference, López Obrador affirmed that the protections promoted by environmental organizations are financed by the United States government, and that is why he ordered the declaration of national security.
Despite the suspensions granted by the judges, the federal government is currently continuing with the construction of section 5 of the Mayan Train.
