Judge allows dismissed Supreme Prosecutor Tomás Gálvez to insist on appeal

The former Supreme Prosecutor Tomas Galvez, who was accused of being a member of the Los Necks Blancos del Puerto criminal network, announced today in style that a constitutional court declared the resolution of the National Board of Justice (JNJ) with which he was removed from office “null.” However, that statement is not accurate.

The head of the Tenth Constitutional Court of Lima decided to annul JNJ resolution No. 059-2021, which on August 9, 2021, declared the ex-prosecutor’s request for reconsideration inadmissible so that his dismissal could be re-evaluated.

Cabrera dismissed the argument of the JNJ, which declared the ex-prosecutor’s appeal inadmissible for presenting it untimely, because he warned that he filed the reconsideration virtually and within the allowed date.

But it was not the only thing that the judge decided. He also rejected Gálvez’s request to annul Resolution No. 025-2021, which was the one that ordered his dismissal as supreme prosecutor on April 23, 2021.

In other words, Tomás Gálvez is still dismissed as a prosecutor, but his appeal is in force.

From the JNJ they indicated to this newspaper that they have not yet been notified of the decision of the Judicial Power, although they clarified that this ruling is appealable.

According to the Prosecutor’s Office, the White Necks was a criminal network that entrenched itself at the top of the justice system that operated for the benefit of its members. The main defendant is the fugitive former Supreme Judge César Hinostroza.
