What happens if 40% do not vote?

If those 37.1 million do not turn out to vote, the process will not be valid.

But regardless of the number of voters or the meaning of their opinion, the General Council of the National Electoral Institute (INE) will carry out the total calculation and the declaration of results.

The declaration and the files will be sent by the INE to the Superior Chamber of the Electoral Court of the Judicial Power of the Federation (TEPJF).

What the INE concludes can be challenged before that jurisdictional body and it has the last word on the validity of the revocation process or, where appropriate, its nullity.

What happens if the option “to follow” AMLO wins?

The ballot has two options: that the mandate of the president be revoked or that he continue in office.

If in addition to the fact that 37.1 million citizens vote, the majority in any percentage think that the president continues in his mandate, so it will be.

If that number of citizens does not vote, President López Obrador will also continue in office.

The duration of the office of President of the Republic is established in article 83 of the Constitution, which states that it will be six years.

“The president will begin to exercise his office on October 1 and will last six years. The citizen who has held the position of President of the Republic, popularly elected, or with the character of interim or substitute, or provisionally assumes the ownership of the Federal Executive, in no case and for no reason may he hold that position again,” he states.

“Whether or not we voted for President Andrés Manuel López Obrador, in 2018 he won with citizen support to be president for five years and 10 months. Finally, he has the obligation to continue in terms of being elected for five years. 10 months and that the Constitution establishes that one of the obligations we have as citizens is to exercise popularly elected positions”, explains the constitutional expert and professor at UNAM, Francisco Burgoa.

What happens if the option to recall the president wins?

If the query is valid because 40% of the list voted and the president won “let him go”, it does not mean that he will leave office.

A third requirement will still be missing for this completion of the commission to be mandatory: that the “revocation” option has been marked by an absolute majority of the voters, that is, half plus one of those who went to the polls.

If at least the required 37.1 million voted, the qualified majority of those who should have asked “for him to leave” would have to be at least 18,564,644 Mexicans.
