Fraud in the Army: Court-Martial declared admissible appeal for amparo filed by former Commander-in-Chief Ricardo Martínez

The Martial Court declared, this Friday, admissible the amparo appeal presented by the defense of the former commander in chief of the Army, Ricardo Martínez, in which they asked to prevent the issuance of an illegal order against him. In addition, at the hearing Minister Romy Rutherford, who is leading the investigation of fraud in the Army, was asked for a report.

This happened a day after the retired general failed to testify at the appointment to which he had been summoned as a defendant; Therefore, the defense attorney, Juan Carlos Manríquez, filed the appeal before the Martial Court, anticipating a possible arrest, arguing that the former officer has seen his “liberty and security” threatened.

“The appeal (for amparo) proceeds specifically since the personal freedom and individual security of my client is disturbed and threatened if an arrest warrant is issued outside the budgets indicated by the Constitution, in a clear affectation of due process and the equality of arms and freedom”, maintained the document declared admissible.

“Confer transfer of the replacement to the State Defense Council and the Military Public Ministry,” says the resolution released this Friday. In addition, Martínez’s defense filed an appeal before the military court led by Rutherford, after the judge’s refusal to agree to the request that the former uniformed man testify at his home.

In addition to that, the reinstatement was filed with an appeal in subsidy, that is, it seeks that the official who issued the resolution revoke or modify its legal action, so in a negative way, if the minister does so, it will immediately go up to Court Martial and also a resolution of the Constitutional Court.
