The Justice will carry out this Wednesday the first hearing for the cause initiated after the shelters presented against the resolution of the Buenos Aires Ministry of Education that prohibits the use of inclusive language in the schools of the city of Buenos Aires.
For this instance, the head of the Court of First Instance in Administrative and Tax Litigation No. 1, Romina Tesone, notified the Minister of Education, Soledad Acuña, and those who presented the amparos: the left-wing referents Celeste Fierro and Vanessa Gagliardi (MST in the FIT Unit) and representatives of the Argentine Federation of Lesbians, Gays, Bisexuals and Trans (Falgbt).
The call is at 11:30 in Courtroom number 8, located at Sui Pacha 150and the director of the Gender in Justice Observatory of the Council of the Judiciary of the city of Buenos Aires will also participate, Diana Mafia.
Simultaneously with the hearing, teachers and activists will carry out a open radio to “manifest the collective repudiation of the measure” of the government of the city of Buenos Aires,” the organizers said in a statement.
On June 9, the Official Gazette of the city of Buenos Aires published resolution 2566/2022 through which the Buenos Aires Ministry of Education prohibited the use of inclusive language in public and private schools of the three levelsboth for learning in the classroom and in communication with families.
After the presentation of a collective amparo by the Falgbt, which requested that the prohibition of the use of inclusive language in Buenos Aires schools and in curricular contents cease, considering that the resolution “violates the right to equality, to non-discrimination and freedom of expression”, and the one presented by Fierro and Gagliardi, the National Institute against Discrimination, Xenophobia and Racism (Inadi) presented itself as “Amicus Curiae / Friends of the Court”.
The agency considered that this measure discriminate those who do not perceive themselves within the masculine-feminine binomial and excludes to the identities recognized by the Gender Identity Law No. 26,743 and Decree No. 476/21, in which non-binary identities are recognized in the National Identity Document.

“The pressure of our protections and the educational community’s rejection of the ban opened this path. We hope that after listening to all parties it becomes clear that the decline in text comprehension is not the fault of inclusive language, but of the deterioration and the adjustment policies applied by the Buenos Aires government,” Fierro said in a statement.
He also assured that “Acuña’s resolution, which is believed to be the language commissioner, attacks basic human rights: freedom of expression and gender identity. That is why we demand its annulment.”
