The Executive power established extraordinary and complementary measures for economic reactivation in the remainder of fiscal year 2022, within the framework of the National Supply System.
The Emergency Decree 020-2022 published on Saturday, August 13 in the legal regulations bulletin of El Peruano, specifies that the regulation will be in force until December 31 of this year with the aim of ensuring the continuity of the contracting processes in this system.
The text has the signature of the President of the Republic, Pedro Castillo; the head of the Council of Ministers, Aníbal Torres; and the Minister of Economy and Finance, Kurt Burneo.
The Government authorizes the entities so that in the selection procedures that are convened they establish that the successful bidder may choose, instead of the obligation to present the guarantees of faithful performance for accessory benefits, the retention of the total amount of the corresponding guarantee.
It is specified that said authorization extends to the selection procedures initiated prior to the entry into force of this regulation, provided that some requirements are met.
The requirements include that for those who do not have a good pro, the entity can grant this power, by communicating its decision in the act of granting the good pro.
Likewise, those who have good pro and prior to their consent, the decision will be communicated to the bidders through the email provided during the selection procedure, at the latest until the day after the good pro’s consent.
The provisions are applicable to contracts for the periodic execution of the supply of goods, services, consultancies and the execution of works, provided that the term of the provision is equal to or greater than 60 calendar days; and at least two payments in favor of the contractor or two periodic valuations based on the progress of the work are considered.
