SANTO DOMINGO.- Ehe Tribunal of Discipline and Ethics of the Dominican Liberation Party (PLD), which decided to “disassociate” José Laluz under the argument of “tacit resignation” was elected by the direct vote of the Central Committee of that organization last July and is chaired by the member of the Political Committee Alejandrina Germán.
Laluz was notified of the Ethics Committee’s decision this Thursday at the offices of the Zol radio station, where he works on the program “Zol of the Morning”.
The Court of Discipline and Ethics is a new figure chosen by the PLD in a process of its Central Committee in which 1,242 members participated who elected four people and the fifth is the delegate of the Political Committee, who chairs it.
The new body is mandated by Law 33-18 on Political Parties, Groups and Movements, which mandates the creation of the National Court and one for each territory (circumscription and municipalities).
In addition to Germán, they are part of that Court of Ethics John Garrido, Manuel Galván, Luis García, Elic Fernández, Teodoro Ursino Reyes and Gustavo Guzmán.
The National Court of Ethics of the PLD has the power to know the statutory or disciplinary violations of the members of the Central Committee, legislators, mayors and national directors of the political organization.
The faults or accusations of the other members of the PLD are known by the territorial ethics committees, but they can later appeal to the National Committee to appeal their decisions.
The decision regarding José Laluz is the first made by that body after they were elected last July and sworn in in August by Danilo Medina at the National House of the PLD.
In the case of the former deputy, there was no trial because the National Court of Discipline and Ethics of the PLD considered that with the public pronouncements made by Laluz it is a “tacit and notorious resignation.”
It refers that the body has had access to various videos and audios in which Laluz expresses himself in the sense that he no longer belongs to the PLD, “markedly acid pronouncements and even, to a certain point, disrespectful towards the Dominican Liberation Party and its leadership”.
It alleges that for the resignation of a member to operate, it is not a sine qua non condition that it has been submitted in writing to the competent authority, “especially when such resignation constitutes a notorious fact, as occurs in the case of Mr. José Felipe Laluz Núñez, who has not only publicly referred to her tacit resignation from the Dominican Liberation Party, but has even done so musically, dedicating a rap referring to pronouncements against the organization and expressing her departure.”
The resolution points out that the actions of the former deputy constitute a bad example for the current and future members of the PLD.
THE DAY called Laluz by phone to seek his reaction, but he did not answer the calls.
However, he reacted critically through his social networks.
“They expelled me without accusing me of anything, without notifying me and without listening to me. They cannot deny that they turned the PLD into a grocery store,” Laluz said.
So far it is not known whether he will appeal to the Superior Electoral Court or the Superior Administrative Court to settle his “disengagement” from the PLD. The notification sent to Laluz does not use the word “expulsion”, but acceptance of a “tacit and notorious resignation”, although what it refers to to justify his action are alleged disciplinary offenses.
