An opinion that is pending debate in the plenary session of Congress would put the survival of thousands of micro and small companies that are dedicated to selling products over the Internet at risk, since it proposes a regulation to the electronic commerce.
This is the opinion that passed on bills 398/2021-CR and 415/2021-CR, which seek to regulate electronic commerce and punish computer fraud, and which were presented by Podemos Peru.
The first of both projects was presented at the initiative of congressman Enrique Wongwhile 415/2021-CR came from Jose Luna Galvez.
“The aforementioned bills intend to regulate security in electronic transactions, which is why when dealing with the same subject matter, their accumulation corresponds,” the document reads.
INTERNET SALES
Although the opinion proposes apparently positive measures such as creating a virtual window for the prevention of computer fraudalso contemplates other provisions that would pose a risk to small businesses that are dedicated to Internet sales.
One of these implies that the aforementioned businesses have a physical space, when precisely the absence of this is a factor that favors thousands of these micro and small businesses.
Another provision that would be harmful against electronic commerce would be a term for returns, which would contemplate that buyers can return the products purchased within a period of up to 15 days, when there are already terms and procedures for several of the businesses that operate through online sales. .
The initiative is not new, since the Consumer Defense Commission it approved it in December 2021 and at the time generated the pronouncement of several business associations.
Some of them were the Pyme Peru Association, the Lima Chamber of Commerce (CCL) and the Peruvian Chamber of Electronic Commerce (Capece).
This last estimate warned about the impact that the approval of an initiative of this type could have, since electronic commerce moved US$9.3 billion during the 2021 period, according to data from that union.
