Elections 2022: these are the restrictions that apply from this week for the regional second round

The National Election Jury (JNE) reported that as of this Monday, November 28, electoral restrictions began to apply in nine regions of the country in order to ensure the correct development of the second round of the elections. which will take place next Sunday, December 4.

In the regions of Amazonas, Cajamarca, Callao, Cusco, Lambayeque, Lima Provinces, Moquegua, Pasco and Piura came into effect from 12:00 am this Monday the prohibition of dissemination or publication of voting intention surveys in the mediain accordance with article 191 of the Organic Law of Elections (LOE).

Next, the restrictions that will be in force in the following days:

  • From two days before the election, political meetings or demonstrations are prohibited.
  • From 24 hours before the election, all kinds of political propaganda are suspended.
  • The sale of alcoholic beverages is prohibited between 08:00 am on Saturday, December 3 and 08:00 am on Monday, December 5.
  • Between 07:00 am and 5:00 pm on Sunday, December 4, voting day, gatherings of voters are not allowed within a radius of less than 100 meters from the voting centers.

In this sense, the electoral body detailed that non-compliance with the provisions will have various sanctions. For the publication of surveys, a fine of between 10 and 100 Tax Units (UIT) will be imposed, that is, between S/46 thousand and S/460 thousand.

For holding political meetings, in accordance with article 190 and 388 of the LOE, will be punished with imprisonment of not less than three months nor more than two years.

For not complying with the suspension of advertising, a fine of between 30 (S/138 thousand) and 100 UIT (S/460 thousand) or a prison sentence of not less than two years will be imposed.

‘Dry Law’

According to the sale of alcoholic beverages It will be punished with imprisonment of no more than six months, a fine of no less than S/3075 and an accessory penalty of disqualification for the same time as the sentence, which may consist of incapacitating the convicted person to perform the function or work he performed.

In this way, the JNE inspectors carry out various operations in the nine regions of the country in order to enforce electoral regulations and guarantee that voting takes place normally.
