According to Legislative Decree No. 713, which dictates the rules for the payment of paid breaks, this is what the company must recognize in different situations related to work on this religious holiday, which also serves to promote internal tourism.
HOW MUCH SHOULD I RECEIVE FOR THE EASTER HOLIDAYS?
Workers have the right to receive for the non-working holiday the ordinary remuneration corresponding to a day of work. Your payment is governed by the provisions of Article 4 of Legislative Decree No. 713. That is, you will be paid without the obligation to go to work.
WHAT HAPPENS IF I WORK HOLIDAY, BUT I RECOVER IT LATER THE DAY?
Workers who agree to work on Good Thursday or Good Friday with a subsequent substitute rest (to be taken the day after) receive double daily remuneration: one for the holiday and another for the work performed.
WHAT HAPPENS IF I WORK ON HOLY WEEK HOLIDAYS?
You will receive a triple payment. The work carried out on non-working holidays without substitute rest will give rise to the payment of the corresponding remuneration for the work carried out, with a surcharge of 100%. This means that private sector workers who agree with their employers to work on Good Thursday or Good Friday or both days, without subsequent substitute rest (they will not recover the day worked), must receive for each holiday triple daily remuneration: one for the holiday, another for the work done and a third remuneration for having worked on a holiday, without subsequent substitute rest.
IF I DO REMOTE WORK, DO I ALSO GET PAID FOR THE EASTER HOLIDAY?
People who perform remote work and do not work on Good Thursday and Good Friday and have the right to receive their remuneration. If you work those days from home, prior agreement with your employer, you are going to work on said holidays, without substitute rest, you will be entitled to triple payment of your daily remuneration.
IF I HAVE MEDICAL REST, DO I GET PAID EASTER HOLIDAYS?
So is. If you are on medical leave on April 14 and 15, which coincides with the first 20 days of health leave in 2022, the employer must pay for holidays without having worked. If the break is after the 21st, the employer pays for the holidays, not as remuneration but as a subsidy, which is reimbursed by EsSalud.
WHAT HAPPENS IF THE HOLIDAYS COINCIDE WITH MY REST DAY?
If you have to rest on April 14 and/or 15, you will receive twice the daily remuneration: one for the weekly rest and another for the holiday.
IF I AM ON VACATION, DO I GET PAID FOR THE HOLIDAY FOR THURSDAY AND GOOD FRIDAY?
If the religious holidays coincide with your annual vacation, you are not entitled to the payment of additional remuneration; Well, before the vacation break, the company paid them their salaries, which already includes holidays.
