Santo Domingo – According to the submission to public consultation that the Ministry of Labor of one resolution that formalizes the domestic workit is sought that the working day in this sector is not greater than eight (8) hours per day.
In addition, in the draft of said resolution it is established that it may not exceed (44) hours per week, having a mandatory rest of not less than (9) hours between shifts.
As for the salary, this may not be less than the minimum salary that for this sector the National Salary Committee and in addition, articles 177 to 191 of the Labor Code will be applicable, in relation to vacations.
Which means that, according to the scale established in these articles, the greater the number of years of labor relationship, the greater the number of rights of holidays the worker will have
Said resolution indicates that the employer must guarantee that domestic workers enjoy decent working and living conditions, within the framework of respect for their privacy and integrity, therefore they deserve effective protection against all forms of abuse, harassment and violence.
Similarly, in terms of benefits, the draft resolution establishes that domestic workers have the right to advance notice payment, which will be accessed according to the rules established in the Labor Code, the same as for other types of workers.
The resolution also provides that the National Social Security Council establishes the mechanism for domestic workers to be registered with Social Security.
