The deputies Francisco Undurraga, Camila Flores and Juan Antonio Coloma will resort to the Constitutional Court (TC) to stop the processing of the project that grants an amnesty to the political prisoners of the social outbreak, because they declare it “unconstitutional” and “a legal harlequin of the left “, assuring that it will not be approved, after being dispatched by the Senate Constitution Commission.
So once again, ultimately, Chile Vamos uses the option of resorting to the TC to stop regulations that the values of the bloc dislike.
According to slogan The Mercury, the parliamentarians accuse that the initiative is an infraction when modifying the pardon for an amnesty; interference in the powers of the Judiciary from the Executive; violation of the duty of the State to protect the population; and arbitrary discrimination in the delivery of the benefit.
Camila Flores (RN) assured that the project “is obviously unconstitutional, because in our country, at least, there is still a separation of State powers and this project intervenes in the Judiciary.” She added that it is discriminatory, since “this benefit would be granted to an important group of people simply for having a certain political ideology.”
On this, deputy Francisco Undurraga (Evópoli) indicated that “it is not legally plausible that the left legislate to the extent of those who committed crimes. The project has mutated for the purposes of achieving its approval, but without any legal rigor.
Likewise, the parliamentarian categorically maintained that “President Boric assumes his responsibility and, if he deems it right, pardons whoever he wants and assumes his political responsibility. This project does not pass in the Chamber or does not pass in the TC.”
Finally, Juan Antonio Coloma (UDI) described this motion as “a legal harlequin of the left”, assuring that “we are not going to lend ourselves to solving a political problem for the future Government, even more so when what is intended is to free to the criminals who destroyed the main urban centers”.
As explained by the president of the bill’s work table, Pedro Araya (IND-PPD committee), in the catalog of crimes associated with the social outbreak that were included for the amnesty are “damage, demonstrations, public disorder , the fire to the extent that no harm was caused to people and there was no danger of spread. On the contrary, the crimes of “frustrated homicide” and that of “job abuse” of police officers and the PDI were left out.
